The Federal Act on Cartels and Other Restraints of Competition of 1995 (revised in 2004 and 2012) grants wider powers to the Federal Competition Commission (ComCo), Switzerland's antitrust agency. ComCo can directly impose penalties on dominant positions, horizontal accords on prices between market-dominant competitors, vertical agreements between producers and wholesalers or retailers imposing a minimum selling price, or distribution monopolies in certain territories. It can order searches of premises and seize documents, a right that it now uses more frequently. The cartel law covers both the public and the private sectors. With its staff of 12 lawyers, economists, and business and consumer representatives, ComCo is an independent agency attached to the Federal Department of Economic Affairs. Its 50-member secretariat does most of the investigating and presents the results to ComCo, which then makes recommendations. If the parties at fault refuse to accept ComCo's recommendations, the department can issue a decision ordering them to do so. Affected parties may appeal to the federal court of first instance and to the Federal Tribunal.
