THE UK government's net zero strategy (NZS) hangs in the balance with the recent High Court ruling of R (Friends of the Earth and others) v Secretary of State for Business, Energy and Industrial Strategy (2022), where the court held that the current NZS is unlawful. The claimants successfully argued that the NZS contravened the government's obligations under the Climate Change Act 2008 (CCA), as it prevented the CCA's carbon targets from being met. The court stated that the strategy lacked detail as to how exactly the cutting of emissions would be achieved, which in turn breached the government's legal duties under the CCA.
