A 50-yearold planning permission and a 20-year-old High Court case were the background to a recent Court of Appeal ruling which may give years of trouble to mineral planners. Hillside Parks Ltd v Snowdonia National Park Authority ([2020] EWCA Civ 1440) considered the following legal tangle. In 1967, the now long-replaced Merionethshire County Council granted planning permission for a new housing estate including 401 units and internal roads. The later discovery of an old quarry within the site caused changes to the scheme's masterplan. Over the years, a series of permissions were granted for smaller numbers of houses, on the same site, which were wholly at variance with the layout of the 1967 permission.
