While ergonomics occupied and recently exited center stage, state and federal courts continued at an increasing pace to shape OSHA law and related developments.Ninth Circuit Court reaffirms the OSHA (Review Comm.) court's in-herent authority to relabel OSHA citations as de minimus.Another court disagrees with OSHA and says technical violations that pose no injury or death risk to employees should be reclassified as de miminus without any penalty or abatement needed. The Ninth Circuit Federal Court agreed with the OSHA trial judge that a nonmoving, unshielded tractor shaft was guarded by location since it was remotely located within structural machine components.
