While the Equal Employment Opportunity Commission (EEOC) admits that being overweight, in and of itself, is not considered an ADA impairment, the agency brought a case in the 6th Circuit Federal Court of Appeals in Cincinnati to determine whether morbid obesity qualified. Morbid obesity is defined as "body weight more than 100 percent over the norm."
