The New York Public Service Commission has several matters pending that will shape the state's retail power market, including two large utility mergers, but it will tackle those issues without Governor Eliot Spitzer's appointee to head the commission. Angela Sparks-Beddoe has withdrawn her nomination to the PSC while another key energy adviser to Spitzer, Steve Mitnick, has resigned his position as assistant secretary for energy and telecommunications. Mitnick was appointed earlier this year to the position, which did not require state Senate confirmation, and he gave Spitzer his resignation on August 3, citing a desire to return to the private sector, said Paul Larrabee, a spokesman for the governor. Mitnick served on the transition team as Spitzer took over from former Governor George Pataki, and he has advised Spitzer on energy policy matters, Larrabee said.
