At its open meeting on Thursday, 3/18/10, FERC approved an order establishing a hearing to consider eight stipulated issues arising from tariff filings in which Texas Eastern Transmission, LP (RP10-30) proposes gas quality and interchangeability standards. Pursuant to section 4 of the Natural Gas Act (NGA), FERC ruled however, Texas Eastern has the right to move the suspended tariff sheets into effect at the end of suspension period and "the Commission has no authority to further suspend or delay implementation of the standards." While the Commission is not rejecting Texas Eastern's proposed tariff standards, "we are setting the stipulated issues for hearing." Texas Eastern had sought this right in a contested March 1 motion and notice, reviewed below.
