摘要

The Scottish Executive announced on 5 November that it is planning to introduce a statutory requirement for an environmental impact assessment to be carried out in most cases before renewal of permission for mineral workings under the review of old mineral planning permissions. The proposals would give planning authorities the power to suspend mineral workings if an operator fails to provide the necessary environmental information within a reasonable time, and introduce a right of appeal against non determination. The measures are needed to ensure that Scotland complies with the EC Directive on Environmental Assessment. The proposals are the subject of consultation until 8 February 2002.The Executive has also commissioned research into the effectiveness of the existing review of old mineral planning procedures to measure the progress that planning authorities have made in reviewing these applications.
