In March North Yorkshire CC examined current issues at Cridling Stubbs Quarry following earlier problems (see Mineral Planning 92 p. 13). Counsel's opinion on the potential to take enforcement action against use of the pecker within the Darrington East area had been received. In Counsel's opinion, use of the pecker constituted a breach of the planning condition requiring the development to be carried out in accordance with the application details. However, Counsel set out a number of reasons why it may not be expedient to take action including the absence of any specific recorded breach of the noise limit condition, the attempts made by the operator to limit disturbance, the potential consequences, in terms of possible closure of the quarry and associated loss of jobs, and the potential for a successful challenge to any enforcement action.
