In June Essex CC further considered the adoption of a new Protocol for the Development and Regulation Committee, and the introduction of public speaking at its meetings. In March the Committee endorsed draft procedures (see Mineral Planning 91 p.24). However, it was necessary to give further consideration in the light of revised guidance published by the Local Government Association on Probity in Planning, and other issues. In May 2002 there was a legal case dealing with, amongst other things, the right to an 'oral' hearing. The Court of Appeal decided a case relating to the development of a new football stadium for Fulham FC, brought by aggrieved local residents challenging why the Secretary of State did not use his powers to call in the application. Amongst other things considered was whether or not there was any real or perceived right to have an oral hearing for the residents' case to be heard. The Court of Appeal concluded that third parties objecting to a planning application had no right to some form of oral hearing before the planning committee of a planning authority.
