This report focuses on the legal framework for investing idle funds and the cash management practices used by cities and counties in the state of Texas. It examines the depository laws and other statutes affecting city and county investment of general operating funds, bond proceeds, and interest and sinking funds. Recognizing the potential earnings as an important source of additional revenue to supplement taxes, local governments are trying to improve their cash management programs. However, ambiguity in depository laws and statutes has created confusion and uncertainty as to the legality of cash management practices. The report makes specific recommendations to update and clarify laws to reflect modern business-like cash management practices.
