摘要

Cubas Constitution formalizes and ratifies the authoritarian political system that has been in effect for over four decades. The current Constitution was first adopted in 1976, extensively revised in 1992, and partially revised in 2002. By itself, the Constitution will not bring about political changes in Cuba. The key question is whether it will hinder or facilitate such changes. This essay argues that a peaceful democratic political transition process will be best served by retaining the current Constitution and amending it only in so far as would be necessary to launch the transition. Then, after the immediate transition, a new Constitution would be drafted and submitted to the voters in a referendum.
