The objectives of this study were to examine the combined effects of selected tort and administrative reforms in Maryland on medical malpractice claim rates and the characteristics of claims filed in the legal system from 1979 through 1989 by privately insured, Medicare, Medicaid and uninsured patients. The hypothesis that reforms have depressed claim filings by restricting access to the legal system cannot be rejected as a result of this analysis, particularly with respect to claims from Medicaid recipients and patients receiving care not covered by insurance at the time of the alleged incident. The results from analyses using several different approaches all suggest that Medicaid recipients were underrepresented among claimants during the second post-reform period, and the uninsured were underrepresented during the entire time period following reforms. Results from the analysis suggest the importance of continuing to monitor the impact of various types of tort and administrative reforms on the access of lower income claimants to an equitable system for claims resolution.
