A questão dos direitos de autor e direitos conexos, assim como o acesso, adivulgação e comercialização da música gravada levantam controvérsia e abalam osector fonográfico mundial. Por um lado, a disseminação indiscriminada das músicas,sem o retorno financeiro respectivo, e por outro, o volume de vendas de músicadecresce de forma acelerada.Perante esta situação, o objectivo deste trabalho é analisar a crise da indústriafonográfica portuguesa, mantendo um paralelismo com a indústria mundial, procurandocompreender os factores que levaram à situação actual, assim como a posição a tomarpor parte do Governo e das editoras discográficas de modo a reverter a crise pela qual osector está a passar.A pesquisa bibliográfica foi crucial para o conhecimento da indústria, assim comopara compreender os factores que levaram à sua ruptura. A análise de diversos estudosefectuados anteriormente contribuiu para a percepção da actual posição da indústriafonográfica, um pouco por todo o mundo. O estudo de caso aplicado permitiu obter asopiniões de alguns intervenientes no mercado fonográfico, como as editorasdiscográficas, artistas e consumidores.Os resultados obtidos demonstram que as editoras são uma parcela importante domercado e que a resolução deste problema também é sua responsabilidade. Um planode negócios inovador, a descentralização do CD, a adopção de novas estratégias e oaproveitamento das novas tecnologias são exemplos de medidas que devem seratendidas pelas editoras no combate à pirataria que está a abalar a indústria doentretenimento em geral. Porém, este estudo também revela que o Governo deveriaaliar-se às editoras no combate a este flagelo, aumentando a fiscalização e punição dapirataria. Contudo, a redução dos preços e a educação da população fariam com que ofactor económico não fosse um incentivo ao desenvolvimento desta prática ilegal, poiso consumidor teria aptidão para adquirir o produto original e notaria os prejuízos deestimular a indústria dos falsificadores. Portanto, a melhor forma de se posicionardiante do problema é enfrentar as suas causas, fazendo com que se tornem menosintensas.Em suma, a reversão da crise depende directamente da eficácia das acções doGoverno e das editoras. A pirataria é o centro de combate da indústria fonográfica. Énecessário ter uma visão optimista da situação e acreditar no resultado das acçõesactuais. É certo que a pirataria não pode ser extinta, no entanto estas tentativas limitamsea tentar deter o seu crescimento impetuoso e a descobrir novas alternativas de receitapara a continuidade da indústria. ABSTRACT: The question of author and related rights, as well as the access, distribution and thecommercialization of recorded music, have contributed for the uprise controversy andshook the phonographic sector. On one hand, there is the dissemination ofindiscriminate music, without financial return; on the other hand, the music salesvolume is decreasing quickly.Regarding this situation, this work’s goal is to analyze the phonographic industrycrisis, maintaining a parallel position with the world industry as well as lookingforward for an understanding of the factors that led to the actual situation. There is alsothe need to comprehend the government and phonographic Editors´s position in orderto find an answer for the sector´s actual crisis.The bibliographic research was fundamental for the industry´s understanding, aswell as for the comprehension of the factors that precede its collapse. The analysis ofseveral studies done beforehand, have contributed for a better perception of thephonographic industry´s actual position all around the world. The case study allowedthe gathering of several intervenients´ opinion from the phonographic market, like thediscographic editors, artists and the consumer in general.The results obtained demonstrated that the discographic industry is in fact animportant part of the market and the resolution of this problem is also theirresponsibility. An innovative business plan, the CD´s loss of importance, the adoptionof new strategies and the use of the new technologies are clear examples of themeasures that should be adopted by the discographic industry in their struggle againstinternet piracy which is changing the whole entertainment industry.However this study also reveals that the government should take side with theeditors in their battle against this scenery, enlarging the audit and punishment of thepiracy. However the price reduction and the population´s education would ensure thatthe economic factor wouldn´t be an incentive for the development of this illegalpractice, because the consumer should have the will to buy the original product andwould also be aware of the prejudice that exists in helping the pirates. So the best wayto understand the problem is to face it´s causes, making them less intense.All in all, the crisis´ reverse depends directly on the government and editor´seffectiveness. Piracy is the center of the phonographic industry´s battle. One must havean optimistic vision of the situation and to believe in the actual action´s result. It iscertain that the piracy cannot be extinguished, but however these attempts are limited intrying to slow down it´s impetuous growth and to discover a new alternative model forthe industry´s development.
