PROBLEM TO BE SOLVED: To provide a driver's mental state determination device which determines a driver's mental state in a short period with high accuracy and a driver's mental state determination system thereof.;SOLUTION: A driver's mental state determination device 1 which is mounted on a vehicle and equipped with a driver's mental state determination means 35 to determine a mental state of a driver comprises; collision risk detection means 18, 19, and 34 which detect risk of collision with a roadblock; and crossing motion sensing means 11-17 and 33 which detect crossing motion of its own vehicle.
