An apparatus and a method for transceiving data in a communication system, and a wireless network for the same are provided to transmit the data by applying a low MCS(Modulation and Coding Scheme) level or excess resource to the data before a serving node performs handover when the data is present in a handover area, thereby improving reception reliability. An RNC(Radio Network Controller) generates data as a PDU(Packet Data Unit), and assigns a sequence number to each PDU. The RNC transmits a PDU#k having a sequence number k to a serving node(301). The serving node transmits the PDU#k and resource information to a UE(User Element)(303). The UE transmits an ACK message, showing that the PDU#k is normally received, to the serving node(305). The RNC transmits a PDU#k+1 having a sequence number k+1 to the serving node(307). The serving node transmits the PDU#k+1 and resource information to the UE. If the UE does not successfully receive the PDU#k+1 or the resource information, the UE transmits an NACK message, showing that the PDU#k+1 is not received, to the serving node(309, 311). The UE transmits a handover request message, showing that the UE will perform handover, to the serving node(313). The serving node transmits the handover request message to a target node(315). The target node performs handover negotiation with the serving node and the RNC to determine whether to allow the handover of the UE or not(317). If so, the target node transmits an RLP(Radio Link Protocol) state request message to the serving node(323). The RLP state request message is for requesting sequence numbers of data successfully received by the UE and sequence numbers of data remained in a buffer to be continuously received by the UE. The serving node transmits an RLP state response message to the target node irrespective of the ACK/NACK/ message for the data transmitted to the UE(325). The target node receives PDU#k+2 from the RNC(327). The target node transmits the PDU#k+2 and resource information to the UE(329). After that, the UE transmits an ACK message, showing that the PDU#k+2 is normally received, to the serving node(331).
