Nationwide thousands of communities are collecting waste materials from Household Hazardous Waste (HHW) collection events, permanent HHW facilities, and curbside collection programs. The primary goal is to prevent the disposal of HHW in municipal solid waste landfills. Latex paint constitutes a significant portion of the materials collected. Many programs have found ways to utilize good quality leftover paints, but few options exist for the reuse of the non-reusable/solidified paints. Even though regulations may allow for the disposal of latex paints in landfills, it is contrary to the goal of HHW collections to pay the cost of collection only to landfill such materials. The California Health and Safety Code (CA HSC) Section 25217-25217.4 states that "No person shall dispose of, or attempt to dispose of liquid latex paint in the land or into the waters of the state unless authorized by applicable provisions of law." The same section exempts latex paints that are recycled from hazardous waste regulations. As a result non-recycled waste latex paints are treated as California regulated hazardous wastes. Although not specified in the HSC the California Department of Toxic Substances Control (DTSC) subsequently interpreted the law to mean that only liquid paints that are "recycled" into usable paints are exempted CA HSC Sections 25217-25217.4 California HSC 25143.2 allows hazardous wastes including but not limited to non-usable latex paints to be exempt from hazardous waste regulations if recycled and the recycling process meets the stringent guidelines of the code. Operating under the strict regulator requirement of both CA HSC 25217-25217.4 and 25143.2, Amazon Environmental Inc. (AEI) recycles all forms of latex paint, liquids or solids at their Whittier, CA facility. AEI re-manufactures paint out of reusable latex paints and employs a patented process (US Patent #08523192) for the recycling of non-reusable latex paints. Chemically similar water based materials (which may or may not be CA regulated wastes) such as caulking, spackling compound, glaze, grout, putty, ink, wood patch, fillers, adhesives, calcium carbonate, gypsum, lime, casein, stains, cement and resins are also recycled by AEI. Approximately 10 million pounds of materials have been manufactured into usable products since AEI began operations in 1995. When possible materials are designated for direct reuse, paints as paints, inks as ink, etc., remaining materials are used to manufacture Processed Latex Pigment (PLP). PLP is manufactured using a patented process from recyclable materials, agglomeration agents and equipment designed by Amazon Environmental, Inc. PLP is shipped to a local cement kiln where it is used as an additive in the production of specialty portland cements. Portland cements must meet strict industry quality standards. PLP replaces virgin chemical additives and thus meets the standards of CA HSC 25143.2(b)(l) which states that recyclable materials may be "used or reused as a safe and effective substitute for commercial products..."
