Lawsuits involving claims by victims that a traffic signal was malfunctioning causing them injury are commonplace. Settlements by public agencies can run from thousands to several million dollars. For agencies that are self-insured, this can be devastating. For example, a case in Lincoln, Nebraska involved a claim by the victim's family that resulted in a record settlement of almost $10M. One of the mitigating factors in the case was the failure of the agency (Nebraska's State Road Department) to correct a malfunction in the operation of the signal that contributed to grave personal injury and permanent disability of one of the drivers involved, even though the problem had been previously documented. In New Jersey a lawsuit involving Kenilworth resulted in the Borough accumulating over $1M in legal fees and having to pay out $3.5M, after it was learned that the traffic signal at the intersection where the crash occurred was found to be deficient.rnIn these and many other cases, the liability exposure to the agency could have been reduced or possibly eliminated had a comprehensive preventive maintenance program for the signals been in place. Adopting a comprehensive maintenance program not only will help ensure that the agency is being proactive in maintaining its signals in accordance with the most current established maintenance practices, but will also identify potential equipment failures before they occur as well as reducing the frequency and severity of response maintenance calls that places both the agency and general public at greater risk.
