摘要

Through the substance reform in criminal matters in Romania, there was achieved a rethinking of currently existing system of criminal liability of minors, giving up the duality of sanctions previously established by the Criminal Code - sanctions and educational measures. Thus, the punishment for juvenile offender was entirely abandoned and there was set a sentencing system based solely on educational measures, custodial or non-custodial. In the future, the rule is the application of non-custodial educational measures for juveniles, the custodial measures being the exception and being reserved for serious offenses or minors who have committed multiple offenses.
