This paper presents an overview of the educational measures provided for in the new Criminal Code, with a balancing test in which are considered the present provisions. In addition to examining the new provisions on the sanctioning system of the juvenile offender in terms of the new Criminal Code, the results consist in making critical remarks on the present and the new regulations. Work can be useful to theoreticians and practitioners in the field as well as to the Romanian legislator who can adapt the texts incrimination to new mutations occurred in the structure of juvenile delinquency. The value of this work consists in the critical examination of the present and the new provisions concerning the application of educational measures to juvenile offenders, as well as to the formulated proposals for the law ferenda.
