Today's specialized literature includes controversies regarding public function and public official. Either they are focused towards proving the legal status or, on the contrary, the contractual status of the public official, or the public official (and implicitly public official) are treated within the concept of status, the ideas from recent doctrine insist on the complexity and specificity of the two institutions. We have to remember one idea: even if every people builds its own administration, the limitations and the character of this administration being dependent on the political regime of the state, because of globalization, more and more an opening towards universality is required for the specific normativity of public function and public official. This study answers these requirements with an application regarding the juridical status of the prefect in Romania.
