Pursuant to 40 C.F.R. Part 60, subpart Cb, known as the Large Municipal Waste Combustor Units; Emission Guidelines; Final Rule; (for combustors greater than 250 tons per day) the Commonwealth of Massachusetts promulgated regulations that were in some instances more stringent than the federal rule. In addition to a mercury limit of 0.028 mg/dscm without a per cent removal factor, the Commonwealth also requires a Material Separation Plan (MSP) for the removal or reduction of mercury containing products from the municipal waste stream. At the present time, the regulation also includes the removal of "other toxic components or toxic precursors as designated by the Department.". Thus far, other components have not been designated. The waste to energy (WTE) companies, the Department of Environmental Protection (DEP), waste to energy member communities and environmental activist groups participated in the development of a guidance document intended to format the content of the MSPs. Subsequently, the WTE companies worked with DEP to draft MSPs that ultimately received public review and implementation.
