基于TMP的中美清洁能源合作知识产权管理模式研究--突破、难点及对策

         

摘要

In the face of the global common pressure of energy saving and emission reduction, as big energy utilization countries, China and the United States which are building new pattern of relationship between great powers, are urgent to carry out cross-border cooperation in the field of clean energy, expand common interests. An appropriate intellectual property sharing and exploitation mechanism is crucial to the initiation, maintenance and promotion of Sino-US cooperation in clean energy research and development. US-China clean energy research center ( CERC ) project is a flagship project in Sino-US clean energy cooperation. CERC’ s pioneering IP management framework provides a channel of interest sharing and disputes resolution for cross-border collaborative research between industry university consortia in two countries. This article analyzes the main contents of CERC IP framework and innovation, evaluates its implementation effectiveness, difficulties, and puts forward some countermeasures and suggestions. Based on this, it proposes a new intellectual property management model for cross-border clean energy research cooperation.%面对全球共同的节能减排压力,作为能源利用大国,正在构建新型大国关系的中国和美国,迫切需要在清洁能源领域开展跨境合作、扩大共同利益面。而知识产权的合理分享和利用机制,是启动、维护和促进两国清洁能源研发合作的关键所在。中美清洁能源联合研究中心( CERC)项目,是中美两国清洁能源合作中的旗舰项目,其开创性的知识产权管理框架,为两国开展跨境产学研联盟合作提供了一个实现利益共享和解决分歧的途径。文章分析了CERC知识产权框架的主要内容及其创新之处,评估其实施成效、实施难点并提出对策建议。基于此,提出适用于其它中外清洁能源合作知识产权管理的新模式。
