There are lack fair standard research on relationship between doctors and patients from the views of law & ethic,in current day.The paper did comparative research and pointed out that legal disputes between doctor and patient are mainly due to legal responsibility.From these results,we know it has extremely animoprtant significances to strengthen medical moral construction in medical departments.%目前人们从法律道德方面对医患关系缺乏比较规范的研究，本文对此加以对照，同时，认为当前医患之间的法律冲突主要是由于医务人员的道德缺陷，而承担法律责任的却是医疗卫生单位，从而得出医疗卫生单位进行医德建设具有极其重要的意义。
