In the long-term judicial practice,Britain and America and other developed countries have evolved"art history","daily idea"and"mixed test"criteria in determining the artistic of the works of applied art.Together with"originality"and"principle of separation"test,these countries have prelimited the identification of works of applied art in a narrow scope.In contrast,the artistic criteria of works of applied art in China are relatively low.Based on the antagonism between art and industry and the commodity attribute of works of applied art,it is rational to improve the artistic criteria of works of applied art.This paper suggests establishing the system of artistic criteria of works of applied art.The system is centered on the"art history"and"daily concept"criteria,combined with the test of separation and originality and supplemented with the principal of inheriting the Chinese tradition.%英美等国在长期的司法实践中对实用艺术作品的艺术性认定发展出"艺术史""日常观念"以及"混合测试"等标准,并结合"原创性"和"分离原则"等将实用艺术作品的认定限定在一定范围之内.相比之下,我国实用艺术作品艺术性标准整体偏低.基于艺术与工业的对立性和实用艺术作品天然的商品属性,应该提高实用艺术作品的艺术性认定标准.建议我国建立以"艺术史"和"日常观念"标准为核心,结合独创性和分离测试,辅以传承中国传统艺术法律原则的实用艺术作品艺术性认定体系.
