The issue of “Copyright Law of Qing Dynasty” declared the birth of the document of Chinese Copyright Law with legal meaning .However , the legal system of copyright in China didn ’ t improved greatly . We could understand the reasons through the analysis on the “survival of the soil” of this legal system from the aspects of economy , culture and politics .The development of Chinese copyright law had a history of hundred years till nowadays , but the legal system which looks increasingly perfect from the aspect of form had been crit -icized drastically .The author believes this criticize is obviously biased .We would understand that the lack of legal culture about respecting for copyright is the essential reason of the status of implementation about Chinese copyright system by using the same path of analysis to the “Copyright Law of Qing Dynasty”.%《大清著作权律》的颁布，宣告法律文本意义上的中国著作权法正式生成。然而，自该法颁布以来，著作权制度在中国并没有得到良好的生长。我们通过对著作权制度之“生存土壤”的经济、文化和政治方面进行分析，不难找到原因。时至今日，中国著作权法的发展已走过了一百年的历史，但形式上看起来日益完善的著作权制度却遭到激烈的指责。不过，这种责难显然是有失偏颇的，我们沿用对《大清著作权律》的分析路径就会发现，缺乏尊重著作权的法律文化才是造成中国著作权制度实施现状的本质原因。
