This paper mainly analyzes and demonstrates three aspects through the formative Hexateuch rules of Oracle Bones from the Yin Ruins, literature recordation legends of characters origin and related archaeological quoting and so on, basically affirmed： pic- tographic of Oracle Bones pictographs, approximately should be the primitive society life about Dawenkou or legend about Yellow Em- peror period, so its pictographic penalty was about this period. It probably could be divided into two types： the primitive ＂Five Mal- treated＂ as origin of Xia - Shang Dynasty ＂Five Penalty＂ and related primitive penalty and so on.%本文主要通过对殷墟甲骨文已形成＂六书＂规律、文字起源的文献记载传说以及相关考古举证等三方面的分析论证,基本确认：甲骨象形文所象形的,至迟大概也应为大汶口或传说中黄帝时期的原始社会生活,因而,它所象形之刑罚也大致应为这一时期的。其大体可以分为两类：作为夏商＂五刑＂渊源的原始＂五虐之刑＂以及其他相关原始刑罚等。
