体育权利是每个公民的基本权利，残疾学生是相对特殊的公民群体，维护残疾学生体育权利对其发展自身，融入社会和享受健康生活有着至关重要的作用。本文选取立法最具代表性的美国、英国、日本和中国进行研究，总结保障残疾学生平等体育权利在立法方面的经验教训，并提出完善我国残疾学生体育权利保护的立法建议，以期保障我国残疾学生体育权利的公平实现。%The sports right is a basic right of the citizen. Disabled-students is a special groups of citizen. That plays a very im-portant role in promoting their development, integrating into society and enjoying a healthy life for keeping the disabled -students’ sports right. This paper focus on the legislation of America, Britain, Japan and China, summarizing the experiences and lessons of the protection of disabled-students’ equal sports right, and put forward the suggestions to ensure the realization of students sports rights equity in disabled-students in China.
