Yuanzuo system,an implicative penal code system based on the patriarchal clan network,had been in existence for over 2000 years of history in ancient China,exerting profound influences on the political and social ecologies of ancient Chinese society.The Tang Code,established and used during the Tang Dynasty,prescribed a relatively complete framework of Yuanzuo system by which a deep understanding of the Yuanzuo system in ancient China was made available.However,in the actual implementation,it was found that there existed some cases of incongruence with the prescriptions of such a system.The long-term prevalence and extensive use of Yuanzuo system in historical periods testified to the inherent value of such a penal code system.From the standpoint of economics,YuanZuo system,though extremely inhumane,was very efficient;and from the perspective of sociology,Yuanzuo system adapted to the characteristics of ancient Chinese society and forged a mandatory link between the family and the state.%缘坐制度在中国历史上存在两千多年之久,对政治与社会生态影响甚大。《唐律》中规定的缘坐制度构建起一个认知中国古代缘坐制度相对完整的框架;但根据对于史料的梳理,可以发现在实际的执行当中,唐代的缘坐案例出现了诸多同制度规定并非一致的情况。缘坐制度在历史上长期而广泛的存在,反映出它所具备的内在价值。从经济的角度讲,缘坐制度的设计虽然极其不人道,但却非常有效率;从社会的角度看,缘坐制度适应中国古代社会特点,成为联络国与家之间的强制性纽带。
