居间主体资格对合同效力的影响

         

摘要

随着市场经济的快速发展,居间服务已广泛存在人们的日常生活当中,因此,由居间服务而引发的纠纷时常发生。但是,我国法律、行政法规对于居间主体资格的约束甚少,是否任何人都可成为适格的居间主体,不适格的主体签订的居问合同是否有效等问题一直困扰着司法实践工作。文章从居问概念出发将居间行为区分为民事居间和商事居间,并根据我国法律的相关规定对于两种不同居间合同效力做出认定,以解决司法实践中的困难。%With the rapid development of market economy, the service of brokers has become common in daily life. Therefore, the dispute caused by this happens frequently. However, Chinese laws and administrative regulations have little restriction on the broker's qualification. The judicial practice work is always troubled by the problems whether anyone could be competent to be a broker, whether the contracts signed by the unqualified brokers are valid or not, and etc. This paper divides the brokerage into civil brokerage and commercial brokerage based on the concept of brokerage and discusses the validity of two different brokerage contracts according to the relevant regulations of Chinese laws so as to solve the difficulties in judicial practice.
