艾滋病作为一种严重的传染病，在现行的法律设置下，难以达到阻断其传播的目的，这将会影响和威胁到其他公民的生命健康权。鉴此，对于艾滋病病毒感染者和艾滋病病人的就医权，应当从强保护向适当限制转化，包括实施定点医院就医、要求艾滋病受检测者向检测机构提供本人真实信息、对艾滋病病毒感染者和艾滋病病人不履行义务的行为科以相应责罚等具体措施，从而维护我国的公共卫生安全和全社会的整体健康利益。%Under the current law setting, since AIDS is a kind of serious infectious diseases, it is difficult to achieve the purpose of blocking its spread, which will impact and threat other citizens' life and health. Therefore, HIV and AIDS patients' right of seeing a doctor should be changed from strong protection to proper limits, in-cluding the implementation of designated hospitals for medical treatment, the requirement for the HIV test-takers to provide true information to the testing agency, and the corresponding punishment to HIV and AIDS patients who failed to perform its obligations, so as to maintain public health and security and the whole society's overall health and interests in our country.
