This paper focuses on the defects existing in the historic building protection policies by the crossing vision of building protection and legal theory. After figuring out the different concepts of "Historic Building"and "Vernacular Architecture", this paper mainly probes into the most important issue, the necessity and objectives of the establishment of unified legislation. Also it can be showed that the legislation of historical building is playing a great positive role in protection of vernacular architecture .%文章以建筑保护理论与法理交叉的视野审视当今历史建筑保护政策层面存在的缺陷，明确“历史建筑”与“风土建筑”概念不同阐释面向之后，通过横向比较、分析原因，重点讨论了历史建筑保护立法工作中的首要问题，即全国统一立法的必要性及其目标设立，也揭示了历史建筑保护统一立法工作对风土建筑保护的重要意义。1）
