摘要

Malaysia is both a potential polluter and a potential claimant and, as the most active player in oil and gas exploration in the region, should be concerned with the development of a civil liability and compensation regime for transboundary oil damage resulting from offshore exploration and exploitation activities. As states in this region have different levels of response capacity, a fund mechanism based on contribution from oil and gas operators is unlikely to be acceptable to Malaysia and its national oil company, PETRONAS. Although the trend in environment liability is towards that of strict liability, this must be considered in light of state practice with regard to state liability. States need not accept strict state liability as the only policy in offshore exploration and exploitation activities.
