Environmental law-Statutory protection of environment - Approvals, licences and orders - Appeals - Practice and procedure - Costs-Director issued approvals under Water Act and Environmental Protection and Enhancement Act to approval holder for development of landfill - Opponents K and H and citizens society appealed approvals - Approvals were varied - K, H and society made submissions on costs - Approval holder was ordered to pay costs of $35,289.47 to K, H and Society, pursuant to s. 96 of Environmental Protection and Enhancement Act - There was obligation for each member of public to accept some responsibility for bringing environmental issues to forefront - Costs were not awarded for breakfasts on days of hearing, but were awarded for dinners on nights hearing went late - Costs were awarded for mileage, but not for adverse driving conditions - Costs were awarded for Society's legal counsel and experts based on starting point of 50 per cent of adjusted costs and increased or decreased depending on level of assistance - Special circumstances were required for costs to be awarded against Director, which were not present in this situation - As project proponent, approval holder was to bear costs as awarded.
