The ABC case considered the situation where the contractor was in culpable delay, but the court's interpretation of the clause applies to any breach of contract, so if using the NEC and the client has amended clause 11.2 (26) to include the NR12 amendment then it bites. In the real world there are many technical breaches of contract by the contractor, from the simple failure to reply to a communication within the period for reply to the cost of correcting defects before completion and many more. By using this amendment, the risk pendulum has definitely swung away from the client and towards the contractor.
