DEEMING provisions as to events being accepted as a compensation event and quotations being deemed to have been accepted in the project manager's silence have been with us for over ten years since the launch of the New Engineering Contract third edition (NEC3). However, there is still a degree of uncertainty as to the timeframes in which the contractor should notify of the project manager's initial failure to respond in both scenarios. Linked to this, there is also a lack of clarity as to how many times the project manager may request a revised quotation for a compensation event prior to eventual acceptance.
