Those who work as design/builders know all too well the strains that might affect a joint venture, a consortium, or some other type of collaborative relationship if and when a construction project begins to sour. Despite the many benefits of joining forces on a design/build project, legal problems between "partners" can arise over any issue: Which party is responsible for estimating errors? Which party is responsible for making initial payments for liquidated damages? What happens when one partner decides to stop performing in the middle of a project? The list goes on. Those contemplating a design/build relationship should also remember that without due care in early business negotiations a dispute between team members can rear its ugly head even before a project begins. A noteworthy example comes from a recent case, Trident Construction Co., Inc., v.Austin Company, originating in South Carolina.
