Does the Government treat farmers more leniently than it does other industries?Since The Waste Management (England and Wales) Regulations 2006 (the Regulations) came into force last year, farmers have been brought into the regulatory regime. Farm tips and burning waste can no longer escape waste laws. Farmers are subject to licensing and/or permitting in line with other industries, although the Regulations insert paragraph 2A into section 41 of the Environment Act 1995 (power to impose licence fees) which states that “...charges may not be prescribed in respect of waste from premises used for agriculture...”.
