Arecent planning case has illustrated the difficulty - currently more acute than ever - of securing planning permission for new landfill projects. Of particular importance for planning authorities and waste management companies is the need to ensure that landfill projects are subjected, prior to the grant of planning permission, to a proper assessment of whether the proposed project is consistent with the principles of Best Practical Environmental Option (BPEO) as set out in UK Waste Strategy 2000. The case, Derbyshire Waste Ltd v John Blewett & Secretary of State for the Environment, Food & Rural Affairs [2004] EWCA Civ 1508, concerning the grant of planning permission to Derbyshire Waste to dispose of waste in a former colliery and to carry out reclamation restoration works, has shown that any permission given to a proposed landfill project which has not been assessed against these principles is vulnerable to judicial review, even if the project is in fact in line with BPEO principles.
