Over recent years the Government has managed to meet its target of 60 percent of all new development being on brownfield land by applying a soft test of what constitutes brownfield - any land that has previously been built upon. This target will be more of a challenge as the less environmentally suspect land has been developed, and sites which require substantial remediation come up for development. It was anticipated that many of these sites would be cleaned up through the contaminated land regime, implemented under Part IIA of the Environmental Protection Act 1990, which came into force back in April 2000.
