One of the themes of the UK Government's efforts over the last decade to address the ever-increasing amount of waste produced in the UK appears to be a marked reluctance to introduce direct obligations or penalties on consumers regarding the generation of household waste. It is true that a number of obligations and penalties are imposed in relation to the generation of household waste, but these are imposed almost exclusively on industrial and commercial interests, and not on consumers and householders. A brief consideration of how the law applies to household packaging waste from the point of generation to disposal confirms this. The corporate individuals involved in the generation and release into the market of packaging materials are obliged under the Producer Responsibility (Packaging Waste) Regulations 1997 to recycle and recover a certain proportion of these materials (provided they come within the threshold tests for the amount of packaging materials involved and annual turnover). Compliance with these obligations is largely invisible to consumers and householders, although there will of course be an impact on the price of packaged goods.
