Environmental regulators have powers to use certain statutory notices to manage and control the behaviour of those they regulate - for example, compliance, enforcement and stop notices. Checks and balances are in place to ensure regulators exercise their powers appropriately. There have been a number of instances recently when regulators have served 'notices' purporting to be statutory notices, because they are labelled in a particular way - for example, as a stop and/or an enforcement notice - but those notices have not complied with the relevant checks and balances, so are not what they claim to be. A stop notice can only be used in very particular circumstances, and gives certain rights to the recipient in relation to compensation arising from any impact on business operations if, for example, the notice has been served inappropriately.
