摘要

In environmental policies today, there is an ideological conflict between the Western conservationist view of property and the perception of property by indigenous people who find sustenance through the land. This paper will look at the traditional Western legal theory of property, with its endorsement of private property rather than common property. It will then review the strengths and weaknesses of the community forestry system of Nepal and its intersection with Western conservation policies. Nepal, which at the writing of this paper, is in the midst of creating a new government system after years of civil war, provides an excellent subject matter to determine appropriate future land and conservation policies. This paper will determine whether Nepal's community forestry system is on the pathway towards the "tragedy of the commons."
