State Court Adjudication of Environmental Rights: Lessons from the Adjudication of the Right to Education and the Right to Welfare
Six state constitutions grant their citizens environmental rights, and many others contain less vigorous language regarding environmental issues. State courts may be understandably uneasy about attempting to flesh out unclear environmental rights provisions. In failing to enforce environmental rights provisions, however, state courts neglect the enacting bodies' deliberate decision to include such a provision in the constitution.
