Prying, Spying, and Lying: Intrusive Newsgathering and What the Law Should Do About It

If the law of invasion of privacy is the child of the seminal Samuel Warren and Louis Brandeis law review article of 1890, then the modern newsgathering and privacy law in Larissa Lidsky's 1998 article, "Prying, Spying, and Lying," can be its grandchild or great-grandchild. While Warren and Brandeis wrote critically in response to the growth and expansion of photography and the gossipy tabloids of their day, Lidsky takes a century's worth of media and technological developments and newsgathering itself to task as well. By the late 1990s, invasion of privacy law had its legs, recognized in various forms in every state and addressed by aspects of a number of federal statutes. However, invasion of privacy law, as Lidsky addresses, was still catching up with both the technology of modern media and the standards of what society deems worthy of legal protections.
