Weeks before it is slated to hear oral argument, an appellate court is seeking new briefs from EPA and environmentalists on whether a suit over an Obama-era guidance for assessing air pollution "hot-spots" is barred by the Clean Air Act's statute of limitations because the petitioners filed the suit more than 60 days after EPA published the guide on its website.
