The Army Corps of Engineers' civilian chief is defending the Corps' effort to resolve ambiguity about when certain waters are subject to the joint EPA-Corps Clean Water Act (CWA) jurisdiction rule, telling senators that the final rule ends any uncertainty and also offering a robust defense of other provisions that critics have attacked. The defense of the rule - detailed in an undated letter to the Senate environment panel obtained by Inside EPA -could hint at some of the arguments the Obama administration might make in pending litigation over the rule. The regulation is designed to resolve confusion about the scope of the CWA, but GOP lawmakers, industry groups and others have said the rule extends the law's reach far beyond what Congress ever intended.
