EPA is citing its ongoing work on a methane emissions reduction strategy for the oil and natural gas industry as a reason for a federal appeals court to extend until Jan. 30 a stay on litigation over the agency's air rule for the sector, while EPA reviews options for curbing oil and gas methane with conventional pollutant controls. In a Dec. 16 unopposed motion filed by the Department of Justice (DOJ) on EPA's behalf, the administration says that it needs the extra time in order to fully review comments filed on a series of methane white papers it released on strategies for curbing emissions of the greenhouse gas methane from the oil and gas sector. An existing stay of the litigation expired Dec. 17, and the court in a Dec. 18 order granted the further extension. "At present, EPA is working towards completing its evaluation of the input it received from peer reviewers and the public in response to the release of the white papers, and its consideration of what actions may be appropriate," DOJ's Brian Lynk writes in the motion in American Petroleum Institute v. EPA, which is a legal challenge to EPA's new source performance standards (NSPS) emission rules for oil and natural gas operations.See page 2 for details.
