Three states and several major mining, energy and other industry groups are backing calls for the Supreme Court to review an appellate decision limiting a Clean Water Act (CWA) "shield" against legal liability under EPA's industrial stormwater general permit, saying the case was flawed and the ruling creates uncertainty for permit holders. In an April 2 amicus brief, the states and industry groups say the justices should step in to protect permit holders from the lower court's "hyper-technical" reading of EPA's multi-sector general permit (MSGP) for stormwater, which they say will open "good-faith permit holders" to citizen suits and other enforcement actions. They want the high court to reverse the U.S. Court of Appeals for the 9th Circuit's ruling to lift the limit on using the shield. The brief is available on lnsideEPA.com. See page 2 for details. ID: 180363) Under normal circumstances, if a Clean Water Act (CWA) permit fails to achieve water quality goals, regulators "can, through applicable regulations, alter or revoke permits as necessary to achieve environmental protection," says the brief. "However, the [9th Circuit] decision below threatens to upend this well-established permitting regime and ascribe liability to permittees who are acting in good-faith reliance on the assurances of their regulators."
