Sen. James Inhofe (R-OK) is investigating what he alleges is EPA's plan to intentionally delay finalizing its first-time utility climate rule until after the 2014 midterm elections in order to shield Democrats from casting a politically controversial vote before the elections on an expected Congressional Review Act (CRA) resolution to scrap the rule. President Obama ordered EPA to re-propose its new source performance standard (NSPS) to reduce greenhouse gas (GHG) emissions from future power plants by Sept. 20, 2013, which replaced an earlier climate NSPS that the agency floated. EPA signed the updated proposal on the date mandated by the president, but the rule did not appear in the Federal Register until Jan. 8, more than three months later - a delay Inhofe sees as driven by politics.
